RE-WRITE THE CONSTITUTION?

by "Al Jailer" <gotcha@[EMAIL PROTECTED] > Feb 16, 2006 at 04:30 PM

NO! BUT HELL NO!!!

IF A CONSTITUTIONAL CONVENTION IS CALLED. THEN YOU CAN KISS ALABAMA AND
THE
USA GOODBYE AND WELCOME IN THE NEW WORLD ORDER!!!!

THE ONLY PLEASURE THAT WE HAVE SHOULD THIS HAPPEN IS IT WILL BE THE
POLITICIANS, LAWYERS AND EDUCATORS THAT WILL BE TAKEN TO THE CONCENTRATION
CAMPS FIRST!!!

FEBRUARY 14, 2006

SPEECH BEFORE SENATE ELECTIONS COMMITTEE, CHAIRMAN W. MITCHELL

There are a few Public Servants calling for a Constitutional Convention to
re-write the Alabama Constitution. Some, having an agenda backed by
special
interests, use the claim that the people are 'calling for it', or it is
too
old, outdated or too long, which is absolutely ludicrous on all counts.
The
people have spoken many times before with a resounding NO to rewriting the
Constitution. The people are NOT calling for a re-write, nor is there a
need
for it!

The Special Interest Group's have three reasons for re-writing the 1901
Alabama Constitution. One, it restricts their form of "Home Rule", two, it
leaves the power to 'tax' in the people's hands and, lastly, it leaves the
control of property in the hands of the people and private landowners.

Our own Alabama history clearly shows that 'Home Rule', as they desire it,
FAILS! Just prior to 1900 several counties and cities 'home ruled'
themselves in to bankruptcy through the public servants' tax and spend.
THAT is the reason we have the checks and balances in the 1901
Constitution:
local governing bodies must run certain items through the legislature for
protection to the citizens, we, the people, thus preventing elected (or
appointed) public servants from 'taxing and spending' the citizens into
bankruptcy again!

Simultaneously, Special Interest Groups want the 'source of power' to be
in
the governing bodies, organizations and Special Interest Groups, that
these
entities might have the power to tax instead of the people having the
power
to control the tax on their own property. Additionally, we have those who
want to remove power from the People to control private property, only to
place the power in the hands of these other entities that they might have
the power to tax the land or confiscate it for private development for
higher tax revenue(s) gains at the expense of the People.

The Web Page of a Special Interest Group's first complaint about the
Alabama
Constitution is: "It restricts local Democracy". Obviously, this Special
Interest Group does not have "We the People" best interest in mind. First,
History clearly shows that a Democracy fails; and Second, the Constitution
guarantees Alabama is a REPUBLIC!

If the Constitution is long then one only has to look to the Alabama
Legislators who have Amended the Alabama Constitution over 770 times!
Alabama's Constitution has one of the strongest Articles of 36 Defined
Rights of the People. A free society demands that man-made government
regulate minimally, only having the authority to protect Life, Liberty and
Property, which will guarantee man's pursuit of HAPPINESS. Anything beyond
that would be an infringement on these certain unalienable Rights.
Instead
of trying to re-write the Constitution, the Branches of Government ought
to
be following the already written Constitution of the Alabama Republic.

Governor Riley appointed a committee early in his tenure to delve into
this
issue. This resulted in a compilation of the Constitution, removing
wording
struck down by the courts and lawful amendments placed in alphabetical
order
by counties. Needing only a vote of the people, it makes this whole issue
of Constitutional Convention a complete waste of time for all.

Every Alabama Legislator took an "Oath of Office". That Oath has words to
the effect that they will UPHOLD, PROTECT and DEFEND the Constitution of
Alabama. With that, I would ask that Representative Newton, Senator
Little
and any other Legislators with bills with the same goal, withdraw them,
leaving the people in peace and without the fear of government 'usurpation
and oppression'.

Thank you for your time and listening ears that hear the true voice of the
people through their current Constitution.
