Dear All,
This article is especially for someone who knows too much about Myanma
politic but knows nothing. This article is for the one who thinks
other leader had done nothing to unite the nation together with ethnic
national races, This article is for the one who never lift one finger
to do something for the country (Burma ) in her entire life. This
article is for the daughter of our great hero General Aung San namely
Ma Su Kyi, for her to learn a thing or two more. For all of us to
understand more clearly about our leaders.whoever they may be, what
are they doing or what they have done for the couintry and the
people.
FLASH BACK.
The Preamble to the Union Constitution ( 1947) reads,
WE THE PEOPLE OF BURMA including the Frontier Area and the Karreni
States, Determined to establish in strength and in unity a SOVEREIGN
INDEPENDENT STATE, To maintain social order on the basis of the
eternal principles of JUSTICE, LIBERTY and EQUALITY and To
guaranteeing secure to all citizens JUSTICE, social , economic, and
political ; LIBERTY of thought and expression , belief, faith,
wor****p, vocation, association and action ; EQUALITY , of status, of
op****tunity, and before the law. IN OUR CONSTITUENT ASSEMBLY this
Tenth day of Thadingyut waxing, 1309 B.E.
( Twenty-fourth day of September, 1947 A.D.) DO HEREBY ADOPT , ENACT
AND GIVE TO OURSELVES THIS CONSTITUTION.
The above term set down the firm resolution of the Union to accept
genuine democracy alone as the basis of its guiding principles.
The thoughts and the mind of our leaders.
The time worn feudal system of rule and hereditary Chiefs in the Shan
State has been existence until today (29 , April 1959.) Therefore in
view of the term of the above Preamble to the Constitution which
mentioned a dedication to democratic principles there would seem to
have been a divergence between theory and practice. Section 154 (2)
and 183 (1) of the Constitution under the provision of which the
feudal states have been allowed to exist, also therefore were clearly
at variance in spirit with fundamental concept underlining the Union
Constitution.
These two sections by the anomalous character of their provisions made
a travesty of the whole constitution. It is therefore necessary to
relate the incidents and consideration s, which had influenced the
inclusion of these sections in the Constitution.
During the country's struggle for Independence, General Aung San and
his associates were beset with diverse problems and difficulties. They
were confronted with the hardest of these problems when the British
attempted to break up the Unity of the nation by weaning away the
Hills people from people of Burma proper.
The British had been planning to grant freedom only to Burma proper,
and they intended to retain the Hill Tracts under their rule. If this
plan should not materialize their alternative scheme was to attempt to
win over the Hill people by promising them member****p of British
Commonwealth. The British worked assiduously towards those ends. They
exploited the comparative lack of political a***en of the Hill peoples
and achieved a certain measure of success in alienating the feelings
of these people away from the Burmese (Bamar) people of Burma proper.
General Aung San and his associates had to tax, their ingenuity
considerably in order to remove the suspicions and misunderstandings
sown in the minds of the Hill people by the British. As a price for
achieving unity of all the indigenous races of the country, General
Aung San had to concede to the wishes of the Saophalongs and had to
guarantee them the accustomed hereditary rights and privileges.
Special sections were included in the Constitution which provided for
their hereditary rights. Similar arrangements were also made to
safeguard the rights of the rights and the privileges of the Saophas
of tge Kayah state
Although the various Chiefs, at that stage, held political concept
which were none too progressive , General Aung San had felt that ,
given sufficient time , they would learn to adopt themselves to the
changing conditions of the time. When that would happened General
Aung San had felt that the Chiefs would of their own accord attempt to
remove the offending Sections from the body of the Constitution , and
they would thus voluntarily divest themselves of their prerogatives.
The resolutions regarding the surrender of hereditary power by the
Chiefs were passed by the respective State Councils of Shan and Kayah
States during March last . The deliberations of the combined Houses of
Nationalities and Deputies in March on the same subject and the
splendid co-operation extended by the Chiefs in the introducing the
new system of Government in the Shan State, all combine to vindicate
the decision then taken by General Aung San.
1947 and 1974 Constitutions are no longer applicable in our
country .Now we have a Brand New Constitution for Union of Myanmar as
necessary and a necessity, adopted by the National Convention or in my
own words the peoples assembly.
Everybody should read it and digest it, to accept it or to reject it.
Because this is for our country and our people. This is for Myanmar
and the people of Myanmar.
This constitution is subject to amendments. All Constitution in the
world are subject to amendments. They are necessary to amend, they
all are. Why amendments were necessary, why amendments were made and
why amendments will be necessary in the future and why they will have
to be made depends on the situation and cir***stances of the country
at the time. As situations and cir***stances and time changes. We all
need to changed.
If and when it is necessary to amend the Constitution , remember, only
The Hluttaws (Parliament) has the right to amend the Constitution.
Nobody , no one group has a right to amend the Constitution.
