SINGA****E Democratic Party (SDP) chief Chee Soon Juan and party sup****ter
Yap
Keng Ho were yesterday found guilty of speaking in public without a permit
in
the run-up to the 2006 General Election. But their sentencing will take
place
only on May 30.

This is because Deputy Public Prosecutor Lim Tse Haw asked for time to
decide
whether to pursue six similar charges that Chee and Yap face.

In acceding to the request, District Judge Jasvender Kaur said she would
decide
on the penalty to be meted out to the duo after DPP Lim notifies the court
of
the decision on those other charges.

Chee and Yap face a maximum fine not exceeding $10,000 each for the
current
charge.

Yesterday, Judge Kaur ruled that the prosecution had proved 'beyond
reasonable
doubt' that both men addressed a crowd illegally on April 8, 2006, in
Woodlands.
This was two weeks before an announcement was made that the general
election
would be on May 6 that year.

This is not the first time that Chee and Yap have been found guilty of
speaking
in public without a permit, which is required under the Public
Entertainment and
Meetings Act. In 2006, Chee and Yap, along with SDP member Gandhi Ambalam,
were
fined $5,000, $2,000 and $3,000 respectively after being convicted of
making a
public speech in Yishun without a permit.

But the trio refused to pay the fines at the time, and opted instead to
serve
jail terms of five weeks, 10 days and three weeks respectively.

Chee was also convicted in 1998, 1999 and 2002 for speaking in public
without a
permit and was jailed seven days, 12 days and five weeks respectively.

Judge Kaur pushed the original sentencing date of May 28 to May 30 after
Chee
said he would be involved on May 28 in a defamation suit filed against
him, his
sister and the SDP by Prime Minister Lee Hsien Loong and Minister Mentor
Lee
Kuan Yew.

Blogger arrested for racist post

Man, 24, picked up after police re****ts were made over rant about MRT
encounter

A BLOGGER has been arrested for posting a racist rant on his website that
has
stoked an online firestorm.

The 24-year-old was taken into custody on Tuesday evening at his Paya
Lebar Way
home, said police.

They accused him of making posts which 'may wound the racial feelings of
another
person'.

A computer, believed to have been used to make the post, was also seized
for
investigations.

The case came to light following two police re****ts made on Monday
complaining
of a virulent online message. It described a man whom the author saw
sitting on
the floor of an MRT train.

The post, which was made on March 18, described the man as 'smelling like
he
didnt showered in years' and said he was wearing 'some really scary dirty
clothes'.

It went on to make racial remarks about the man, and even challenged
anyone of
that race to refute what he had written.

The post was featured on the blog Tomorrow.sg, which combines comments
from
several personal websites. It was linked to a number of blogs and popular
online
forums where it has caused a furore among netizens.

One forum user said on The Straits Times online discussion board
yesterday:
'Freedom of speech comes with much responsibility.'

Lawyer Sha**** Nathan stressed that bloggers need to be wary about the
fallout
from their posts.

He said: 'Netizens need to strike a fine balance between freedom of speech
and
racial responsibility. It affects the country as a whole.'

On his blog called ***y Fragrance Prince, the blogger has posted an
apology.

He said: 'I would like to express my sincere apologies for any
misinterpretation
to my blog entry. I should have been more mindful.'

This is not the first time a blogger has got into hot water over a post.

In 2005, two people were convicted of posting racist remarks on their
personal
websites. One was jailed for a month and the other was jailed for one day
and
fined $5,000.

Anyone who deliberately wounds the religious or racial feelings of another
may
be jailed for up to three years and fined.
